Benchmark Education’s The Fluency Development Lesson: Closing the Reading Gap Webinar Giveaway Terms and Conditions  

SPONSOR: Benchmark Education, with an address of 145 Huguenot Street, 8th Floor, New Rochelle, NY 10801 (the "Sponsor").   

ELIGIBILITY: This Giveaway is open to those who register, attend, and stay to the end of the live Benchmark Education “Closing the Gap: How the Fluency Development Lesson Scaffolds Students Towards Grade Level Texts" webinar on September 18, 2024. By participating in the Giveaway as described in these Terms and Conditions (the "Giveaway Terms"), entrants represent and warrant that they are complying with these Giveaway Terms (including, without limitation, all eligibility requirements). Registration for the webinar will open on August 27, 2024 and will close on September 18, 2024. You must attend the entire webinar on September 18, 2024 to be eligible for the giveaway. The Giveaway is open only to legal residents of the 50 States of the United States of America and the District of Columbia who are 18 years of age or older at the time of entry.  Employees, officers and representatives of Sponsor and its related companies and each of their respective officers, directors, employees, shareholders, and agents (collectively, “Sweepstakes Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such individual (whether related or not) are not eligible. Subject to all federal, state and local laws and regulations. Void in Puerto Rico, Guam, the U.S. Virgin Islands, and where prohibited by law.  

AGREEMENT TO OFFICIAL RULES:  By participating in the Giveaway, each entrant unconditionally agrees to and accepts these Terms and Conditions and the decisions of Sponsor, which are final and binding in all matters related to the Giveaway.  

PRIZE: Two Prizes consisting of a copy of the book The Fluency Development Lesson: Closing the Reading Gap (each a “Prize”) will be issued – one to each winner of the drawing. The Approximate Retail Value (the “ARV”) of the Prize is: $34.95.

HOW TO CLAIM A PRIZE: No purchase necessary. To enter for a chance to win the Prize, register for the webinar and attend until the end to be included in the randomized drawing. Sponsor will contact the two (2) winners via email within 48 hours of the live announcement of the drawing results to request a valid United States address to mail the Prize. The Prize will be shipped to the winners by October 31, 2024. Sponsor is not responsible for any inability to access the webinar, Giveaway or claim a Prize due to difficulty accessing the Internet, service outage or delays, computer difficulties and other technological problems.  

PRIZE RESTRICTIONS AND AVAILABILITY: The Prize is not for resale, has no cash value, and will not be replaced if lost or stolen.  

DRAWINGS:  A drawing resulting in the award of two winners of a Prize will be held on or about September 18, 2024, following the Q&A portion of the live webinar and will be conducted in accordance with these Terms and Conditions.  The random drawing will be conducted from among all eligible entries received in accordance with these Terms and Conditions by Sponsor, whose decisions as to the administration of the Giveaway and the selection of a potential winner are final and binding. Entrants selected must comply with all Terms and Conditions of these Terms and Conditions and winning is contingent upon fulfilling all requirements. The winners will be announced at the end of the webinar and will receive the Prize within 10 business days. If Prize is not received within 10 business days the potential winner must contact Sponsor via our customer service telephone number: 1-877-236-2465. The potential Prize winners may be required to sign and return an affidavit of eligibility and liability/publicity release within 10 days of notification. If a potential winner cannot be contacted, the Prize is returned as undeliverable, or the potential winner fails to sign and return the affidavit of eligibility within the required time period, potential winner forfeits the Prize. In the event that a potential winner is disqualified for any reason, Sponsor will award his/her Prize to an alternate potential winner. Only two alternate potential winners will be selected after which the Prize will remain unawarded. Odds of winning depend on the number of eligible entries.  

OTHER RULES: This Giveaway is subject to all applicable laws and is void where prohibited. Winner assumes all liability for any injuries or damage caused or claimed to be caused by participation in this Giveaway or by the use or misuse of the Prize. If, in the Sponsor's opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Giveaway, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Giveaway, the Sponsor reserves the right to terminate the Giveaway and award the Prize in its sole discretion. Any attempt to deliberately damage the Sponsor's website(s) or undermine the legitimate operation of the Giveaway may be in violation of U.S. criminal and civil laws and will result in disqualification from the Giveaway. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages (including attorneys' fees) to the fullest extent of the law, including pursuing criminal prosecution.

LIMIT: One entry per person. Entries in excess of this limit will be void.

DISPUTES: As a condition of participating in the Giveaway, participants agree that any and all disputes that cannot be resolved between entrant and Sponsor, and causes of action arising out of or connected with the Giveaway or these Terms and Conditions, shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in the County of Westchester in the State of New York, and entrant irrevocably consents to the jurisdiction of the federal and state courts located in the County of Westchester in the State of New York with respect to any such dispute, cause of action, or other matter. All disputes will be governed and controlled by the laws of the State of New York (without regard for its conflicts-of-laws principles). Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby irrevocably waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs incurred directly in connection with entrant's participation in the Giveaway), and entrant further irrevocably waives all rights to have damages multiplied or increased, if any. WINNERS LIST: Giveaway results and a copy of these Terms and Conditions may be obtained by sending a self-addressed, stamped envelope to Benchmark Education Company LLC, 145 Huguenot Street, New Rochelle, NY 10801. Requests must be received within 60 days of the end of the Promotion Period.
